CHAPTER 1 GENERAL PROVISIONS

1. The rules of operation of the esehotel.lt electronic reservation system managed by UAB SPA ESĖ regulate the sale of accommodation and health care services (hereinafter - the Services) offered by ESĖ through UAB SPA ESĖ (registered office address: Algirdo St. 34, Birštonas; code 305146955, tel .: +370 680 83285, e-mail info@esehotel.lt, hereinafter - (“ESĖ”) electronic reservation system https://booking.esehotel.lt (hereinafter - electronic reservation system), procedure and “ ESĖ ”and the client's mutual rights, duties and responsibilities.

2. ESĖ reserves the right to amend and supplement these rules at any time. When using the electronic reservation system, the rules in force at the time of booking apply.

3. ESĖ does not assume any risk and is unconditionally released from liability if the customer has not been fully acquainted with these rules, even though he has been given such an opportunity.

4. The following have the right to place orders in the electronic reservation system:

4.1. able-bodied natural persons, i. y. persons who have reached the age of majority and whose capacity is not restricted by court order;

4.2. minors between the ages of 14 and 18 only with the consent of their parents or guardians, unless they are self-employed;

4.3. legal persons acting through authorized representatives;

4.4. authorized representatives of all persons referred to in Sub-paragraphs 4.1 to 4.3 of these Rules.

5. ESĖ has the right to restrict the use of the electronic reservation system without notice to the customer if the Customer materially violates the requirements of these rules, for example, the customer attempts to compromise the stability and / or security of the electronic reservation system.

6. The information in the electronic reservation system is provided in Lithuanian, Russian and English.

7. Terms used in these Rules shall be understood as defined in the EUES Rules for the Provision of Services.

CHAPTER 2 CONNECTING TO THE ELECTRONIC RESERVATION SYSTEM

8. Customers can purchase services by connecting to the electronic reservation system and providing the following information:

8.1. name and surname of a natural person, contact telephone number, e-mail mail;

8.2. Customer data is entered only for the purpose of order confirmation. The customer's account is not created in the electronic reservation system and data on previous reservations are not collected.

9. If the customer's registration data changes, it must be updated immediately. ESĖ will not be liable for any damage caused to the customer and / or third parties if the customer provided incorrect and / or incomplete personal data, did not provide or supplemented the data as a result of their change.

10. Personal data provided by the Customer shall be processed in accordance with the Law on the Legal Protection of Personal Data of the Republic of Lithuania and other legal acts regulating the processing of personal data. In processing and storing the buyer's personal data, ESĖ follows the Privacy Policy to ensure the protection of personal data from accidental or unlawful destruction, alteration, disclosure, as well as from any other unlawful processing. The customer's personal data is processed for direct marketing purposes only with the customer's consent. The customer's consent is marked in the electronic reservation system in the appropriate field. The person making a gift voucher for another person or making a reservation for the benefit of another (other) persons undertakes to ensure that the data of these persons will be provided to ESĖ with their knowledge and consent.

11. Upon request to ESĖ, the Customer always has the right to access his / her personal data processed by ESĖ, to find out how they are processed, to demand rectification, destruction of his data or to suspend, except for storage, his data processing operations when the data is processed. without complying with the provisions of the Law on the Legal Protection of Personal Data and other legal acts regulating the processing of personal data.

12. Customers' personal data will be used and stored in accordance with the procedure and terms established in the Privacy Policy.

CHAPTER 3 PROCEDURE AND TERMS OF SELECTION AND PAYMENT OF RESERVATIONS

13. The customer is given the opportunity to choose the offered service packages (according to the offers valid on that day, the Package may include accommodation, meals and separate health services) or standard nights, which are provided in the reservation table, with an indication of possible date .

14. After getting acquainted with the composition and price of the Package, the Customer can choose the desired free reservation date for the selected room and additional conditions or the package.

15. After selecting the offer, the Customer must proceed to the next stage of the reservation - a form in which he / she indicates his / her personal data and his / her comments / wishes regarding the reservation.

16. In order for the Customer's reservation to be valid, the Customer must pay an advance. The customer can make an advance payment in one of the following ways:

16.1. credit card (Visa, Mastercard, Eurocard);

16.2. electronic bank transfer (EVP International);

16.3. pay by bank transfer or later;

17. After selecting the payment option specified in clauses 16.1 or 16.2, the Customer is directed to the website, where he can make a payment using the EVP International system. Data authorization begins by connecting to the system with the help of EVP International system encrypted 128-bit protocol. When EVP International accepts the payment, the Customer is automatically notified by e-mail. by letter confirming payment and reservation. El. the letter will include the customer's details, the name of the hotel, the total price of the accommodation, the advance paid and the amount to be paid at the hotel, other terms of service. The remaining amount for the purchased night is paid by the Customer at the hotel. Booking confirmation email the letter must be presented at the hotel as proof of the advance paid and a calculation of the balance.

Client, who uses an account in the BookingRobot system has the ability to link his credit card (s) to the account. In this case, each time you purchase a hotel service, a monetary amount will be debited from the customer's credit account automatically, once, at the time of purchase. No additional payments are required. A card link can be canceled at any time in account settings, by pressing "Delete" button. The data security of the client’s credit cards is provided by UAB Paysera LT, accredited by the Lithuanian Bank.

18. If the Customer chooses the option specified in Clause 16.3 (pay by bank transfer or later), he / she will e-mail. will receive a confirmation of the initial booking by post, but the booking will only be finally confirmed by paying the advance by simple bank transfer or online. The reservation is considered the original 48 hours after its booking and, during that time, can be canceled without an advance. Upon receipt of the advance by ESĖ, an e-mail confirming the reservation will be sent to the Customer. a letter stating the customer's details, the name of the hotel, the total price of the accommodation, the advance paid and the amount to be paid at the hotel, other terms of service. The customer submits this letter to the hotel administrator for final payment.

19. Reservation on request. In the absence of the desired free space in the electronic reservation system, the Customer may fill in the request form. After filling in the form, the Client e-mails. receives a confirmation (or no) of the deadline and information on how to pay the advance by post. The customer can pay the advance by credit card, electronic or simple bank transfer. The reservation will only be confirmed upon receipt of the advance upon receipt. After paying the advance, the Customer will receive an e-mail. a letter stating the customer's details, the name of the hotel, the total price of the accommodation, the advance paid and the amount to be paid at the hotel, other terms of service to be provided upon arrival at the hotel for final payment.

20. In the electronic reservation system, the prices of services are indicated in euros, including value added tax, which do not include the 1 (one) euro / day set by Birštonas Municipal Council. tourism tax, which is calculated additionally on the basis of tariffs and procedures approved by Birštonas Municipal Council (available at www.birstonas.lt).

21. Before paying the advance, the customer confirms that he / she has read the ESĖ electronic reservation system operation rules by checking the box next to "I have read and agree to the privacy policy and order rules". The customer is not given the opportunity to make a reservation if he is not familiar with these rules and does not confirm it.

22. When ESĖ receives the payment confirmation, it is considered that a service agreement has been concluded between the customer and ESĖ. ESĖ shall not be liable for the fact that the service contract was not concluded due to the non-timely confirmation of the payment under the conditions specified in these Rules.

CHAPTER 4 RULES FOR ORDERING GIFT COUPONS

23. The gift voucher (s) confirms the right of the gift voucher (s) holder to use the services for the amount specified in the gift voucher (s).

24. Holders of gift voucher (s) can only use ESĖ services. If the purchased coupon is for services - pre-registration by e-mail is required. info@esehotel.lt or tel. +370 680 83285.

25. If the price of the requested services exceeds the value of the gift voucher (s), the difference may be paid in cash or by card at the reception.

26. Gift voucher (s) are not exchangeable for cash.

27. Gift voucher (s) are valid for 3 months. from the date of acquisition, unless otherwise stated.

28. If the gift voucher (s) has not been used during its (their) period of validity, it shall expire and the money paid for its price shall not be refunded.

29. If the holder of the gift voucher(s) purchases services for an amount lower than indicated in the gift voucher(s), the remaining amount will not be refunded to the holder of the gift voucher(s).

30. A VAT invoice shall not be issued to the holder of the gift voucher(s) who pays with the gift voucher(s).

31. Gift voucher(s) must be redeemed in one visit.

CHAPTER 5 PROVISION OF SERVICES, CANCELLATION OF RESERVATION

32. The services are provided exclusively by ESĖ.

33. The customer has the right to cancel his reservation no later than 7 days before the start of the service by writing to info@esehotel.lt. In this case, ESĖ must return the full advance paid by the customer within 10 working days from the submission of all information required for payment.

34. In case the customer wishes to cancel his reservation less than 7 days before the start of the service or does not arrive at ESĖ without providing any information, the customer is refunded all advances paid, deducted from the refundable amount in accordance with the procedure set forth in Clause 33 of the Rules. ”Losses incurred as a result of such late cancellation or non-arrival. The price of the first night, if booked, will be considered the minimum loss of "ESĖ".

CHAPTER 6 SETTLEMENT OF DISPUTES

35. All disagreements arising between the client and ESĖ regarding the implementation of these rules shall be resolved through negotiations. If no agreement is reached, disagreements shall be resolved in accordance with the procedure established by the legal acts of the Republic of Lithuania.

36. In order to submit a claim or solve a problem, the customer must contact ESĖ in writing. Possible ways to submit a claim and written request:

36.1 by sending an e-mail email: info@esehotel.lt;

36.2. sending to: Algirdo st. 34, Birstonas;

36.3. directly on weekdays from 8 am to 6 pm. upon arrival at ESĖ.

37. The Customer may apply to the State Consumer Rights Protection Service for the out-of-court settlement of consumer disputes (Vilniaus St. 25, LT-01402 Vilnius, e-mail tarnyba@vvtat.lt, telephone (8 5) 262 6751, website www.vvtat. lt) or fill in the application form on the Electronic Dispute Resolution (ADR) platform http://ec.europa.eu/odr/.

CHAPTER 7

FINAL PROVISIONS

38. Other issues not covered by these rules, related to the acquisition of services at www.esehotel.lt, are subject to the provisions of the ESĖ Rules for Provision of Services.

Hotel Internal Rules

RULES OF PROCEDURE OF THE HOTEL

  1. Guests arriving at the “Esė” Hotel must present a valid ID.
  2. Upon arrival at the “Esė” Hotel, the guest is provided with a guest card, which must be filled in with the data of a valid identity document (passport, identity card), if the guest comes without prior online check-in.
  3. Arrival of individual guests at the “Esė” Hotel from 15:00, departure until 12:00. (departure of groups until 11 am)
  4. The administrator of the "Esė" uses the data of the submitted document when registering the arriving guest, and after completing the registration - returns the identity document to the guest.
  5. The guest must pay the bill on the day of arrival (exceptions may apply).
  6. If the identity document is presented at the time of online booking or online check-in, it is not necessary to re-submit the document upon arrival.
  7. At the request of the guest of "Esė", if possible, an additional place is provided at an additional cost.
  8. The accommodation fee is paid according to the established prices in the price list of the period (EUR). Payment can be made in cash or by bank‘s credit card.
  9. "Esė" guests staying in the hotel for less than 24 hours (24 hours) pay the price of the whole day, regardless of the payment hour.
  10. Late check-out (extended stay until 18:00) is available at the hotel guest's request according to availability at an additional cost.
  11. Advance reservations are confirmed upon advance payment of the reservation fee.
  12. In case of cancellation, earlier than 7 days before the date of arrival, a cancellation fee of 50% of the paid booking fee will be applied.
  13. In case of cancellation of the reservation, later than 7 days before the date of arrival, the cancellation fee is equal to the total amount of the reservation fee paid.
  14. A guest who has paid for the services provided by the hotel but decides not to use them will not be refunded. Leaving the hotel earlier than expected in the reservation( if the guest does not stay for the whole reserved time), the money for the time the guest does not stay will not be refunded to the guest. In case of no-show, a fee will be charged for the actual downtime of the “Esė” room.
  15. Visitors staying in the “Esė” room (s) after 22:00 must check in at the “Esė” by presenting valid identity documents (passports, ID cards) and paying for the accommodation.
  16. The hotel is open 24 hours a day.
  17. Guests arriving with pets (up to 10 kg body weight) must notify the administration in advance and the owner of the animal must prove (by presenting the animal's passport) that the animal is not aggressive, noisy and cannot harm other hotel guests or hotel premises and property. There is an additional charge for pets.
  18. “Esė” reserves the right not to admit unwanted persons in accordance with the hotel's internal rules and other local or Lithuanian regulations.
  19. If the hotel inventory is lost or damaged, the perpetrators shall compensate the damage with a ratio of 1: 2. If guests cannot be accommodated due to damage, the full price of the room will be paid during the damage elimination period.
  20. Parents (guardians) or accompanying adults take full responsibility for the health, safety, appropriate behavior and compliance with these rules for children under the age of 18 and disabled people living in the Hotel.
  21. The Hotel has the right to debit the relevant amount for the goods and / or services from the Guest's account (credit card, etc.) for all services and goods that the “Esė” guests have purchased or used but have left without paying for certain reasons. Guests undertake to pay in full for the purchased goods and / or services even after departure.
  22. Guests must keep valuables in the safe in the administration. The hotel is not responsible for items left in the room.
  23. Filming and photography in the territory and premises of the “Esė”, respecting the privacy of guests, for public or commercial purposes, is possible only with the written consent of the administration.
  24. Persons under 14 years of age after 20:00. are not allowed in the pool and sauna area.
  25. We confirm that personal data is processed in a lawful, fair and transparent manner.
  26. When booking a room (s) in a hotel, the guest agrees to the processing of the following personal data of him / her: 1. name, surname; 2. Gender; 3. password; 4. credit card details; 5. the amount due; 6. life in a hotel; 7 Email adress; The received personal data is stored for 3 (three) calendar years from the date of data submission. For marketing purposes, data may only be processed with the individual consent of the customer.
  1. PROHIBITED IN THE HOTEL
  2. Move furniture (without the approval of the administration).
  3. Store “Esė” in rooms and spaces with flammable materials.
  4. Damage to hotel inventory.
  5. More persons than in the hotel administrator are accommodated in the hotel room.
  6. In case of failure of the hotel inventory, do not notify the administration.
  7. Leave electrical appliances on.
  8. To use electrical devices, except when those devices have been taken from the administration and the administration has been notified in advance about the use of such devices. (It is not forbidden to use various chargers: computers, telephones, shavers, hair dryers).
  9. Keep animals and birds in rooms without prior notice to the administration.
  10. Keep aggressive animals that could harm other hotel guests, property or inventory.
  11. To prevent other guests of the “Esė” from enjoying the rest.
  12. Noise (i.e. loud playing of music, loud singing, playing musical instruments, shouting, whistling and other unauthorized behavior) is prohibited in the Hotel and / or on the Hotel premises from 22:00 to 7:00. If the guest (s) does not comply with this insurance and thus disturbs the public seriousness and disturbs other persons living and / or working in the Hotel, a fine of EUR 200.00 shall be imposed on him / her and other losses related to this event shall be reimbursed.
  13. Smoking in rooms and hotel terraces and balconies is strictly prohibited. The fine is EUR 150. For your safety, all rooms are equipped with smoke and fire alarms.
  14. It is prohibited to leave young children unattended in the rooms, and parents or guardians of minor children (caregivers) must ensure the safety of children in the hotel.
  15. To bring outsiders to the hotel room without informing the hotel administrator.
  16. It is prohibited to bring life-threatening tools, weapons or other means into the hotel territory.
  17. To import, use, store and consume any narcotic drugs or other psychotropic substances. In all such cases, the “Esė” administration calls the police.
  18. It is forbidden to arbitrarily carry dishes from the gastro bar to the hotel rooms. Except for hotel room catering.
  19. It is prohibited to bring alcoholic beverages purchased outside the hotel to the rooms.
  20. Failure to comply with the general internal rules of the hotel and all legal acts of the Republic of Lithuania, which define the safety of persons and the prevention of any other potential threats.

GUESTS LIVING IN THE HOTEL MUST

  1. ​​Follow the general rules of hotel use.
  2. Pay immediately for all services provided (exceptions may apply in individual cases).
  3. When leaving the hotel, hand over the door key to the hotel administrator, if one has been provided and make sure that all services are paid for, hand over the occupied room.
  4. Strictly follow fire safety rules.
  5. When leaving the room, make sure that all electrical appliances are properly turned off: lights, TV, etc.
  6. Be sure to check that all hot and cold water taps are tightly closed.
  7. When leaving, make sure that the room is securely locked and no unauthorized person can enter it.
  8. If there is any fault in the hotel guest room, it is necessary to notify the hotel administrator.
  9. The hotel room key can be issued only upon presentation of an identity document by the hotel guest. If the room key is lost or damaged, the fine is 15 Euros.
  10. For the guest, until 2 p.m. if the room is not vacated and it is not possible to contact him, or when the Guest does not maliciously pay for the provided services and does not vacate the room at the request of the administration - the administration reserves the right to move the items in the room to the hotel.
  11. In the hotel administration, the committee of two competent staff members, after consultation, has the right to decide unilaterally to nominate the hotel guest (s) without prior notice. Such actions are taken only to ensure the safety and peaceful rest of all hotel guests.
  12. In an emergency, hotel guests must first contact the reception on +370 680 83285.

III. HOTEL GUEST SERVICE AND PREMISES MAINTENANCE

  1. Breakfast is served at the hotel from 08:00 to 11.
  2. The hotel room service is open from 08:00 until 17:00.
  3. Hotel premises, equipment, furniture and bedding must be clean and tidy.
  4. Hotel staff may repair small premises and inventory without disturbing the rest of the hotel guests.
  5. Room temperature during the heating season must be at least + 18 ° C.
  6. For security reasons, the “Esė” administration has the right to enter the living quarters of hotel guests.
  7. The hotel administration, upon finding the left items, shall, if possible, return them to the owners immediately. If the owner is not found, the forgotten items are realized in accordance with the established procedure after 6 months.
  8. The hotel is not responsible for unsafe and lost valuables and / or damage to them in the “Esė” room, spa or pool and sauna area.
  9. When hotel guests behave illegally, criminally (in violation of the laws of the Republic of Lithuania), the administration always applies to the competent authorities. In accordance with the laws of the Republic of Lithuania, all disputes are heard in Lithuanian courts.
  10. For your safety, the public areas of the “Esė” are equipped with video surveillance cameras.
  1. STATEMENTS AND REQUESTS
  2. The hotel administration is always waiting for guests' requests and suggestions in order to improve the quality of services provided.
  3. Hotel guests' offers and complaints are considered within the deadlines set by the administration and management meetings.

SPA AND POOL OPENING HOURS

Hotel guests can use the pool and sauna complex:

8 a.m. to 9 p.m. Adults.

9 a.m. to 8 p.m. Adults with children.

RULES FOR SWIMMING POOL AND BATH SPACE

  1. The depth of the pool is 1.4 meters, therefore it can be used only by visitors who know how to swim.
  2. Only go to the changing rooms with footwear protected by a special device - booties - protected from possible dirt.
  3. From 8 p.m. The pool and sauna area can only be visited by people over 14 years old.
  4. Staff have the right to politely ask parents / guardians that after 8 p.m. under 12 years people would leave the pool and sauna area.
  5. When leaving the pool, leave bathrobes and towels in the boxes in the changing rooms. Guests staying at the hotel do not have to leave their bathrobes in the changing rooms.
  6. Guests under the age of 18 shall be admitted to the pool and sauna area only if they are accompanied by adult persons supervising them.
  7. The guest must leave outdoor clothes in the cloakroom at the hotel reception, and other clothes in the changing rooms (men's or women's locker rooms).
  8. Before visiting the pool and sauna area, the guest must pay for the services at the reception.
  9. Visitation of persons intoxicated by alcohol, narcotic drugs or psychotropic substances for the safety of themselves or other persons is prohibited in the pool and sauna area. Guests suspected of being intoxicated by alcohol, narcotics or psychotropic substances have the right to request pool staff from the pool and sauna area without compensation for the entrance fee paid.
  10. Staff are not responsible for children left without adult supervision.
  11. A disabled guest who requires the care of another person due to his or her state of health may visit the swimming pool only if he or she is accompanied by an adult who cares for him or her.
  12. A guest in the pool and sauna area must:
  13. take a thorough shower before and after visiting the pool, sauna or jacuzzi;
  14. take a shower after the pool or sauna, wipe in the shower and only then go to the changing room;
  15. wear swimwear;
  16. wear suitable slippers in a damp room;
  17. We recommend tying longer hair with a rubber band for hair;
  18. before going to any sauna, get acquainted with the rules of using the saunas;
  19. in the lounge area on the loungers under the whole body to stretch a towel;
  20. Before using the services provided by the Pool, the visitor must make sure that his / her health condition allows him / her to use them. The negative consequences of non-compliance with this requirement are borne by the visitor himself; if you experience any health problems, immediately contact a nearby person or administration;
  21. In the event of a fire, leave the pool and sauna area immediately, evacuate according to the evacuation plan of the pool and sauna area;
  22. The depth of the main pool is 1.4 meters, therefore it can be used only by visitors who know how to swim.
  23. The following is prohibited in the pool and sauna area:
  24. carry and use personal cosmetics and hygiene products (eg shaving, depilation, masks, scrubs);
  25. use your infusions, extracts, cosmetics and brooms in saunas;
  26. under the pool and sauna space to carry chairs, sunbeds;
  27. bring drinks and food;
  28. spit on the floor and into the water;
  29. to pour various liquids into the pools, to put dirty objects in the water;
  30. smoking;
  31. carry glass containers to the pool and sauna area;
  32. jump into the water from the edges of the pool, run, climb various constructions, make noise, falsely cry for help;
  33. to navigate erratically, disturbing other visitors;
  34. children under 3 years of age to swim in the pool without diapers, specially designed for use in water (the institution reserves the right to impose a fine or to claim compensation for damage caused by disruption and cleaning of the pool);
  35. littering, urinating, emptying or otherwise polluting water, changing rooms and other pool and sauna areas;
  36. chewing gum;
  37. to visit patients suffering from infectious, viral or other infectious diseases, as well as persons with open wounds and / or other health disorders that may endanger the health and / or life of the person or other visitors;
  38. visit with animals;
  39. ride prams in the pool and sauna area;

(Penalties from EUR 50 to EUR 200 apply accordingly for non-compliance with these rules.)

  1. A guest who has caused damage to the property belongings to the “Esė”, guest property and their health shall be liable in accordance with the procedure established by the laws of the Republic of Lithuania. Damage caused by minors or persons with disabilities is the responsibility of their parents or guardians.
  2. A guest who does not comply with the rules of procedure may be warned or required to leave the pool and sauna area immediately, as well as be fined and permanently barred from visiting the pool and sauna area.

PERSONNEL IS NOT RESPONSIBLE FOR PERSONAL ITEMS LEAVED UNATTENDED. ITEMS FOUND ARE STORED AT THE HOTEL RECEPTION FOR THREE WORKING DAYS.

  1. SPA TREATMENTS

VII. SPA LABEL

  1. Spa etiquette is a set of rules or regulations that you should be aware of before going to a spa and that you are reluctant to ask.
  2. Arrive at least 10 minutes before the spa procedure so you have time to check in, change into comfortable clothes and relax;
  3. Make the most of your time to relax and unwind in the spa. We urge you not to bring electronic devices (mobile phones, tablets and laptops, etc.) to the SPA center;
  4. we recommend wearing only suitable clothing and footwear, i. y. In the SPA center - slippers or other comfortable, non-outdoor footwear, in the pool and sauna complex - slippers, suitable for wearing in a humid/slippery environment;
  5. a warm shower before the procedure will be great for relaxation and even more enjoyment during the procedure;
  6. we do not recommend starting the procedure on an empty stomach or immediately after a meal, avoid heavy food for at least one hour before the procedure;
  7. If you have ordered a massage or body treatment or are going to go to the sauna, we recommend drinking more fluids. Sufficient fluids in the body will ensure the maximum detoxifying effect;
  8. alcohol and procedures - incompatible things, do not drink alcohol before and immediately after procedures;
  9. Avoid shaving or depilation on the day of the procedure, especially if you plan to scrub your body. The products used may irritate the skin;
  10. We recommend coming to the procedures without make-up;
  11. At the beginning of the procedure, tell the spa staff about your health problems that may affect the performance of the procedure. Not all procedures work for absolutely everyone;
  12. Be sure to let us know if you are expecting, we will choose a procedure suitable for expectant mothers;
  13. Be sure to mention if you are wearing contact lenses before facial procedures;
  14. We are a family-friendly hotel, but when using the spa services, please take care of your little ones. Under 18s guests must be supervised by an adult. We offer special treatments for the little ones and recommend consulting our spa / reception staff to help you make the right choice.

By this privacy policy (hereinafter – the Privacy Policy) private limited liability company UAB “SPA ESĖ”, entity’s code 305146955, office address at Algirdo str. 34, Birštonas (hereinafter – the Data Controller) establishes the conditions for processing of personal data when using the website www.esehotel.lt and www.esehotel.lt (hereinafter – the Website) managed by the Data Controller, and visiting the mineral spa facility ESĖ. The conditions established by the Privacy Policy shall apply each time you visit the mineral spa facility ESĖ or the Website, regardless of what kind of device (computer, mobile phone, tablet, TV or other) you are using.

It is very important that you read the Privacy Policy carefully, for each time you visit the Website owned by the Data Controller, the mineral spa facility ESĖ, you consent to the conditions described in this Privacy Policy. The Data Controller will collect personal data in compliance with the requirements of legal acts of the European Union and the Republic of Lithuania being in force and the instructions of controlling authorities. PROCESSING OF PERSONAL DATA FOR THE PURPOSE OF ACCOMMODATION AND PROVISION OF SPA SERVICES

Processing of data of the Clients. The Data Controller shall process the following data of the Clients

  • Date of birth;
  • Personal number;
  • Data of the personal identity documents;
  • Address of the place of residence;
  • Car number;
  • Employer’s data;
  • Information on participation in loyalty program
  • Telephone number;
  • E-mail address;
  • Health data – if required for proper selection of services;
  • Other information related to the good and/or service being purchased.

In the event the Client is being represented by another person, the Data Controller shall process the following personal data of the Client‘s representative:

  •  Name;
  • Surname;
  • Relation to the Data Subject who is contacting;
  • Telephone number;
  • E-mail address.

The Data Controller undertakes to not transfer your personal data to any unrelated third parties, except for the following cases:

- if your consent to disclosure of personal data is given;

- in provision of services – to our partners, in order to perform the services you ordered. We will provide your personal information to these service providers only in as much as is necessary for performance of the relevant service;

- in fulfilling legitimate interests of the Data Controller (e. g. in the case of debt recovery);

- to authorised institutions in accordance with the procedure provided for by the legal acts of the Republic of Lithuania.

The Data Controller may provide personal data of the Clients and other Data Subjects to Data processors not indicated in this Privacy Policy which provide services (perform works) to the Data Controller and process personal data of the Clients and the Data Subjects on behalf of the Data Controller. The Data processors shall have the right to process personal data only in accordance with the instructions of the Data Controller and only to the extent necessary for proper performance of obligations established in the contract. When engaging the data processors the Data Controller shall take all necessary precautions to ensure that the data processors have implemented appropriate organisational and technical measures ensuring security and maintain the personal data secrecy.

The basis for the processing of personal data for the purposes of providing accommodation services is: the data subject’s consent and/or the performance of a contract with the Data Subject and/or compliance with the Data Controller’s legal obligations and/or protection of the Data Controller’s legitimate interests (Art. 6 (1) (a), (b), (c) and (f) of the General Data Protection Regulation).

PROCESSING OF PERSONAL DATA FOR THE PURPOSES OF PERSONNEL SELECTION OF CANDIDATES TO JOB POSITIONS

The Data Controller shall process the personal data voluntarily provided by the Candidate for the purposes of personnel selection to the extent the personal data was provided.

Data is received directly from candidates and/or form third persons providing job posting websites. This data is not transferred to third persons.

Data of the Candidates shall be processed on the basis of consent given when providing their data and in order to take steps upon the Candidate’s conduct and/or request prior to entering into a contract (Art. 6 (1) (a) and (b) of the General Data Protection Regulation).

PROCESSING OF PERSONAL DATA FOR THE PURPOSES OF ORGANISING GAMES, CAMPAIGNS, CONTESTS

The Data Controller may process personal data for the purposes of carrying out contests or campaigns only with the Data Subjects’ consent. The Data Controller may collect the following personal data of the Participants:

  • Surname;
  • Photos;
  • Telephone;
  • E-mail.

The data is received directly from the Data Subjects participating in games, campaigns and/or contests. This data is not transferred to third persons, but may be publicly announced on the Data Subject’s Website and/or the social network “Facebook” accounts which belong to the Data Controller. The Data Controller may post: name, surname, photo.

Personal data shall be processed on the basis of consent given when providing own personal data (Art. 6 (1) (a) of the General Data Protection Regulation).

PROCESSING OF PERSONAL DATA FOR THE PURPOSE OF DIRECT MARKETING

The Data Controller seeks to share with the recipients of newsletters only the relevant news about services, discounts, offers, contests and other useful information. This is implemented in accordance with this Privacy Policy.

The Data Controller shall process personal data for the purpose of direct marketing only with the expressly given Data Subjects’ consent. For the purpose of direct marketing the following personal data of the Clients and other Data Subjects shall be processed:

  • Information on participation in loyalty program;

Pursuant to the personal data you provided for the purpose of direct marketing your personal data may be profiled in order to offer you individually customised solutions and offers. Personal data is received directly from the Data Subjects. The Data Controller may transfer personal data only to third persons which provide specialised services in order to send e-mail letters, customise the format of advertising ordered through the advertising platforms.

Personal data of the Clients and other Data Subjects shall be processed on the basis of consent given when providing own data and consenting to the processing of personal data for the purpose of direct marketing (Art. 6 (1) (a) of the General Data Protection Regulation).

We hereby inform you that the Data Subject has the right to object to or at any time withdraw his consent to processing of his personal data for the purposes of direct marketing, including profiling, to the extent it is related to such direct marketing, without giving reasons for objection:

PROCESSING OF PERSONAL DATA FOR THE PURPOSES OF ENSURING SAFETY OF PERSONNEL, CLIENTS AND PROTECTION OF PROPERTY (VIDEO SURVEILLANCE)

For the purposes of ensuring security of personnel, clients and other persons who got into the area under the video surveillance, also of the property (of video surveillance) the Data Controller shall process video data of its personnel and clients, also other persons who got into the area under the video surveillance in order to ensure safety thereof and of the property.

We hereby inform you that your video data is recorded by the Data Controller’s video surveillance equipment when you visit the Data Controller’s premises and territory. Video data may only be transferred to law enforcement institutions in accordance with the procedure provided for by the legal acts of the Republic of Lithuania.

Personal data shall be processed for the purpose of video surveillance on the basis of the legitimate interest of the Data Controller (Art. 6 (1) (f) of the General Data Protection Regulation).

We have installed physical and technical measures to protect all information which we collect for the purposes of proving our services. 1 year from the day of carrying out the contest.

Processing of personal data of the Data Subjects for the purpose of direct marketing

5 years from the day of obtaining consent, except for the cases where the Data Subject is willing to extend this time limit.

Exceptions regarding the time limits for storage may be established to the extent they do not infringe the rights of the Data Subjects, are in line with the legal requirements and are properly documented.

Upon expiry of the established time limits, if they were not extended, the data will be deleted in the way that makes them irrecoverable.

YOUR RIGHTS

The Data Subject, whose data is processed in the activities of the Data Controller, shall have the following rights:

- To be aware (to be informed) of the processing of his data (the right to know);

- To access his data and learn how it is processed (the right of access);

- To request rectification or, taking into account the purposes of the processing of personal data, completion of the person’s incomplete personal data (the right to rectification);

- Shall have the right to obtain from the personal Data Controller restriction of processing of personal data where one of the legitimate reasons is present (the right to restriction):

- To lodge a complaint with the State Data Protection Inspectorate of the Republic of Lithuania.

The Data Subject shall have the right to submit any request or instruction related to the processing of personal data to the Data Controller in writing in one of the following ways: by delivering directly at the address Algirdo str. 34, Birštonas; by mail at: Algirdo str. 34, Birštonas; by e-mail at: info@esehotel.lt.

Having received such request or instruction not later than within one month from the day of contacting the Data Controller shall submit a reply and perform the actions indicated in the request or refuse to perform thereof. If necessary, the said period may be extended by further two months taking into account the complexity and number of requests. In such event, the Data Controller shall inform the Data Subject of such extension within one month from the day of receipt of the request, together with the reasons for the delay.

The Data Controller is allowed to not enable the data subjects to exercise the aforementioned rights, except for the objection to the processing of personal data in the way of direct marketing, when in the cases provided for by laws it is necessary to ensure the prevention, investigation and detection of crimes, breaches of occupational or professional ethics, as well as the protection of rights and freedoms of the Data Subject, Data Controller or other persons.
